The FBI has asked a federal court in Washington, D.C., to permit it to submit confidential explanations for why some records relating to an old investigation linked to President Bola Ahmed Tinubu should remain undisclosed.

The development is part of a long-running Freedom of Information Act (FOIA) case involving requests for records concerning Tinubu from the 1990s.

According to court filings, one request sought the entire FBI file relating to Tinubu, while another sought FBI interview records from a 1992–1993 investigation. The requests were filed by American businessman Aaron Greenspan.

Why the FBI Wants the Records Withheld

The FBI said it had relied on several exemptions under the US Freedom of Information Act, including provisions covering personal privacy, confidential sources and law-enforcement information.

The agency argued that releasing some of the withheld material could reveal investigative techniques and procedures. It also said disclosure could reasonably be expected to endanger the life or physical safety of an individual.

The FBI is seeking permission to provide part of its explanation privately and under seal, meaning the information would be reviewed by the judge but not placed on the public court record.

Court to Review FBI's Argument

The case is before US District Judge Beryl Howell in the District Court for the District of Columbia.

The FBI said that, if permitted, it would submit confidential declarations to the court for an in-camera review. Reports indicate the agency is expected to make the submission by August 28.

The latest development follows earlier proceedings in which the court dealt with requests for the release of records relating to allegations surrounding Tinubu.

Background to the Records

The controversy relates to a US investigation dating back to the 1990s and allegations concerning drug trafficking. Tinubu has consistently been the subject of political and legal controversy over the matter.

Importantly, the current FBI filing does not establish that the allegations are true. Rather, it concerns whether certain US government records should be disclosed publicly and whether the FBI can legally withhold portions of them under FOIA exemptions.

Earlier reports also stated that Tinubu's legal team had joined a request by the US Justice Department for additional time to respond in the case. A judge subsequently limited the extension granted to the government.

What Happens Next?

The immediate focus is now on the FBI's confidential submission and the court's eventual decision on whether the agency's reasons for withholding the records satisfy US freedom-of-information law.

The outcome could determine whether some of the long-sought records become public or remain protected from disclosure.
